For the purpose of this Statute, ‘war
crimes’ means:
Grave breaches of the Geneva
Conventions of August 12, 1949,
namely, any of the following acts
against persons or property
protected under the provisions of
the relevant Geneva Convention
Other serious violations of
the laws and customs
applicable in international
armed conflict, within the
established framework of
international law.
In the case of an armed conflict not of an international character,
serious violations of article 3 common to the four Geneva
Conventions of 12 August 1949, namely, any of the following
acts committed against persons taking no active part in the
hostilities, including members of armed forces who have laid
down their arms and those placed hors de combat by sickness,
wounds, detention or any other cause.
Other serious violations of the laws
and customs applicable in armed
conflicts not of an international
character, within the established
framework of international law.
The formal concept of war crimes emerged from the codification of the
customary international law that applied to warfare between soveriegn
states, among them:
1. Lieber Code - It defined command responsibility for war crimes and
crimes against humanity.
2. Geneva Convensions
1st - Amelioration of the Condition of the Wounded and
Sick in Armed Forces in the Field
2nd - Amelioration of the Wounded, Sick and Shipwrecked
Member of the Armed Forces at Sea
3rd - Treatment of Prisoners of War.
4th - Protection of Civilian Persons in Time of War
Some Heads of state and government
accused of war crimes

2. Former Serbian President Slobodan Milosevic

3. Former Libyan leader Muammar Gaddafi
