An act providing for stronger deterrence and special protection


against child abuse, exploitation and discrimination
and for other purposes
ARTICLE 1: Title, Policy, Principles and
Definition of Terms

Section 1: Title
“Special Protection of Children Against Abuse,
Exploitation and Discrimination Act”
Section 2: Declaration of Policy

“…to provide special protection to children from all


forms of abuse, neglect, cruelty, exploitation and discrimination
and other conditions…to protect and rehabilitate children
gravely threatened or endangered…the best interests of children
shall be the paramount consideration…”
Section 3: Definition of Terms
(a) Children - below 18 years of age or those over but
are unable fully take care of themselves

(b) Child Abuse - maltreatment whether habitual or not:


(1) psychological and physical abuse
(2) acts that degrades child’s dignity
(3) unreasonable deprivation of their
needs
(4) failure to give medical treatment

(c) Circumstances- situations that that threaten them:


(1) armed conflict community
(3) living in and fending for themselves in the streets
(4) member of the indigenous cultural community
(5) victim of man-made or natural disaster calamity

(d) Comprehensive Programs against child abuse, exploitation


and discrimination – refers to programs and facilities

(1) Child Prostitution and other Sexual Abuse


(2) Child Trafficking
(3) Obscene Publications and Indecent Shows
(4) Other acts of abuses
(5) Circumstances that threaten and endanger their
survival

PROGRAM ON CHILD ABUSE, EXPLOITATION AND
