Описка
зроблена судом механічна (мимовільна,
випадкова) граматична помилка в рішенні,
допущена під час його письмово-вербального
викладення (помилка в правописі, розділових
знаках тощо).

*Верховний Суд у постанові від 29 січня 2021 року у справі №22-ц/354/11 наголошує на тому, що суд може
виправити лише власні помилки, допущені під час складання судового рішення.
Суд, який видав виконавчий документ, може за заявою стягувача або боржника
виправити помилку, допущену при його оформленні або видачі, чи визнати
виконавчий документ таким, що не підлягає виконанню.

Причини через які суд визнає, що виконавчий

документ не підлягає виконанню повністю або
частково:

● якщо його було видано помилково

● якщо обов’язок боржника відсутній
повністю чи частково у зв’язку з його
припиненням, добровільним виконанням
боржником чи іншою особою
● з інших причин.
Суд розглядає заяву в десятиденний строк з дня її
надходження у судовому засіданні з повідомленням
стягувача та боржника і постановляє ухвалу. Неявка
стягувача і боржника не є перешкодою для розгляду
заяви.
До розгляду заяви суд має право своєю ухвалою
зупинити виконання за виконавчим документом або
заборонити приймати виконавчий документ до
виконання.
Про виправлення помилки у виконавчому документі та
визнання його таким, що не підлягає виконанню, суд
постановляє ухвалу. Якщо стягнення за таким
виконавчим документом уже відбулося повністю або
частково, суд одночасно з вирішенням вказаних питань
на вимогу боржника стягує на його користь
безпідставно одержане стягувачем за виконавчим
документом.
 Верховний Суд у складі колегії суддів Першої судової палати
Касаційного цивільного суду по справі №2008/1-295/11
зазначив, що у випадку, якщо дублікат виконавчого листа,
виданий (виготовлений) на підставі ухвали суду про видачу
дубліката виконавчого листа, містить в собі неточності, помилки
тощо, стягувач або боржник можуть скористатися правом,
наданим їм статтею 432 ЦПК України, та звернутися до суду із
заявою про виправлення помилки у виконавчому документі
(дублікаті).

Отже, помилки, неточності, виявлені у виконавчому документі, зокрема і виданому на

підставі ухвали суду про видачу дубліката виконавчого листа, є підставою для їх
виправлення згідно з нормами процесуального закону, а не підставою для оскарження
ухвали суду про видачу дубліката виконавчого листа.
