Quy phạm pháp luật là một dạng của quy phạm xã hội.
• QUY PHẠM PHÁP LUẬT
Quy phạm pháp luật là quy tắc hành vi mang tính
bắt buộc chung do Nhà nước ban hành và đảm bảo
thực hiện bằng tính cưỡng chế của Nhà nước.

Ví dụ: Công dân có nghĩa vụ đóng thuế và lao

động công ích theo quy định của pháp luật ( Điều
80 Hiến pháp 1992).

● Khái niệm
Giả định là một bộ phận của quy phạm pháp luật
trong đó nêu lên những hoàn cảnh, điều kiện có thể xảy
ra trong cuộc sống và cá nhân hay tổ chức nào ở vào
những hoàn cảnh, điều kiện đó phải chịu sự tác động
của quy phạm pháp luật đó. Trong giả định của quy
phạm pháp luật cũng nêu lên chủ thể nào ở vào những
điều kiện, hoàn cảnh đó.

ĐẶC ĐIỂM CỦA CÁC NGÀNH LUẬT

- Quy phạm pháp luật hình sự: là những quy tắc xử sự do

nhà nước ban hành để điều chinh quan hệ giữa các chủ thể
khi tham gia quan hệ hình sự, thể hiện qua các điều luật.

Ví dụ: Bộ phận mô tả tội phạm tại Điều 132 BLHS:“ Người

nào thấy người khác đang ở trong tình trạng nguy hiếm đến
tính mạng, tuy có điều kiện mà không cứu giúp dẫn đến hậu
quả người đó chết". (hành vi phạm tội).
ĐẶC ĐIỂM CỦA CÁC NGÀNH LUẬT
- Quy phạm pháp luật dân sự: là những quy tắc xử sự
chung do Nhà nước đặt ra để điều chỉnh quan hệ tài sản và
quan hệ nhân thân thuộc đối tượng điều chỉnh của luật Dân
sự để các quan hệ đó phát sinh, thay đổi, chấm dứt phù hợp
với ý chí của Nhà nước.

Ví dụ: Điều 76 bộ luật dân sự 2015 quy định: " Pháp nhân
phi thương mại là pháp nhân không có mục tiêu chính là tìm
kiếm lợi nhuận, nếu có lợi nhuận thì cũng không được phân
chia cho các thành viên".
ĐẶC ĐIỂM CỦA CÁC NGÀNH LUẬT

- Quy phạm pháp luật hành chính: nhằm điều chỉnh các
quan hệ xã hội trong quá trình quản lí hành chính nhà
nước.

Ví dụ: Thủ tướng Chính phủ xem xét, quyết định bãi bỏ hoặc đình
chỉ việc thi hành một phần hoặc toàn bộ văn bản quy phạm pháp
luật của bộ trưởng, thủ trưởng cơ quan ngang bộ... trái với Hiến
pháp, luật và văn bản quy phạm pháp luật của cơ quan nhà nước
cấp trên”. Xem: Khoản 2 Điều 165 Luật ban hành văn bản quy
phạm pháp luật năm 2015.

thể thực hiện quyền và nghĩa vụ pháp lí hay tiến hành áp dụng pháp luật
để giải quyết các vụ việc.

Thông thường những quy phạm này thường liên quan đến quy định về
hình thức văn bản, trình bày bố cục như đơn từ trong đơn ly hôn, đơn
khiếu nại...(thường khi quy phạm sẽ bị trả lại và không được xử lý)

những vấn đề thực tiễn cần phải giải quyết trong quá trình
quản lý, điều hành.

 Tạo điều kiện để tăng việc làm và tăng thu nhập( tạo điều
kiện cho chủ sở hữu tiếp cận với công nghệ thông tin và thị
trường, các kĩ năng tín dụng và quản lý qua đó giúp họ tăng
năng suất lao động và tăng thu nhập)
 Đưa ra các biện pháp pháp để ở rộng thị trường tiêu thụ
hàng hóa, thị trường lao động… đồng thời phát huy các
nguồn lực
• Góp phần làm ổn định trật tự xã
hội, tạo cơ hội quản lý tốt và phát
triển luôn luôn được đảm bảo bằng
sức mạnh cưỡng chế của nhà nước
 • Làm thay đổi các hành vi xử sự
không mong muốn và thiết lập các
hành vi xử sự phù hợp:
 Để tạo điều kiện phát triển, cần thay đổi hành vi xử sự của nhân dân, đặc
biệt là cán bộ của nhà nước ( Các cán bộ nhà nước là những người đầu tiên
có trách nhiệm bảo đảm một xã hội công bằng, văn minh, dân chủ và thay
mặt cho những người mà họ đại diện, đó là nhân dân.)
 Các cán bộ địa phương một mặt thực hiện các nhiệm vụ mà pháp luật quy
định nhưng mặt khác, đây cũng là sự phó thác của nhân dân đối với đại
diện trực tiếp (Hội đồng nhân dân) hay gián tiếp (Uỷ ban nhân dân) của
mình trong bộ máy chính quyền
 Để tránh sự lộng quyền của cán bộ thực thi pháp luật, chỉ có sự quy định
chặt chẽ của văn bản pháp luật mới bảo đảm trách nhiệm của những cơ
quan thực thi pháp luật, cán bộ thực thi pháp luật, từ đó bảo đảm lợi ích của
người dân.
 Tóm lại, văn bản quy phạm pháp luật có vai trò
vô cùng quan trọng: không chỉ quy định các giá trị
mà người quản lý coi đó là giá trị cơ bản của xã hội,
không chỉ đưa ra các biện pháp khuyến khích thực
thi pháp luật, đem lại ổn định trật tự xã hội mà còn
bảo đảm cho xã hội phát triển.
