THE INDUSTRIAL DISPUTES

ACT , 1947
Meaning of industrial Disputes-

 An industrial Dispute may be defined as a conflict or difference of


opinion between management and workers in the terms of
employment.
 It is a disagreement between an employer and employees
representives , usually a trade union , and other working conditions
and can result in industrial actions.
Objectives-

 To Avoid Unfair Trade practices.


 To promote collective bargaining.
 To prevent illegal strikes and lockout.
 Investigation and settlement of industrial disputes.
 Promotion of measures for securing amity and good relations between employers
and employees.
 To provide relief to workers against layoffs , retrenchment , wrongful dismissals.
Reason/causes of industrial disputes-

 1-Wages and benefits.


 2-job security.
 3-poor working condition
 4-unfair labor practices
 5-discrimination
Effects of industrial disputes-

 Industrial disputes will lead to-


 Reduced productivity
 Loss of profits
 Damage to reputation
 Increased employee turnover
Methods for settlement of industrial disputes-

1-CONCILIATION
2-COURT OF INQUIRY
3-ARBITRATION
4-ADJUDICATION
 1-CONCILIATION-

conciliation is a form of mediation.


Mediation is the act of making active efforts to bring two
conflicting parties to compromise.
2-COURT OF INQUIRY-
if conciliation fails to settle a dispute, the govt. can appoint a
court of inquiry to enquire into any matter connected with or
relevant to industrial disputes.
The court is expected to submit its report within 6 months
 3-ARBITRATION-Arbitration offers an opportunity for
a solution of the dispute through an arbitrator jointly
appointed by the parties to the dispute.

 4- ADJUDICATION-
 the ultimate remedy for the settlement of an industrial dispute
is its reference to adjudication by labor court or tribunals
when conciliation machinery fails to bring about a settlement.
Adjudication consists of settling disputes through intervention
by the third party appointed by the govt.
