 BACKGROUND

Thousands of Rohingya asylum seekers have crowded

the shores of Aceh since November 2023.
Some of them are found to have refugee status from
UNHCR and It originates from Bangladesh and
Malaysia, not directly from Myanmar.
They are suspected to have fled and become involved
with international human trafficking syndicates

The arrival of refugees and asylum seekers, Aceh brings social and economic impacts.
• There are rejections by the Aceh community and Local students staged non-anarchic
protests because they are being selective with food provided by the community and
refusing donated secondhand clothes. (Social)

 BACKGROUND

In Between November-Januari 2024, a total of 1.608

Rohingya were disembarked from 11 boats at various
locations in Aceh and North Sumatra.

 REFUGEES
Refugees are individuals who have been granted special protection
status by the receiving country because they have been forced to
leave their home country due to reasons such as war, conflict,
violence, or persecution.
They are registered and recognized as refugees by UHNCR.
Refugees are individuals or groups fleeing their home country due
to conflict, persecution, and human rights violations.
ASYLUM SEEKERS
Asylum seekers, are individuals who have left their
home country due to conflict, persecution, and
human rights violations. and applied for protection
in another country, but their status as refugees has
not yet been determined or officially recognized by
the UNHCR.

The refugees receive cards from UNHCR.

 REGULATIONS
Regulations concerning REFUGEES at the INTERNATIONAL level primarily stem from international
treaties and conventions.

1 UNHCR Statute: The United Nations High
Commissioner for Refugees (UNHCR) is mandated to
lead and coordinate international action for the
protection of refugees and resolve refugee problems
worldwide. Its statute outlines its functions and
responsibilities.
2 1967 Protocol Relating to the Status of Refugees: This
protocol removed the geographic and temporal
restrictions of the 1951 Convention, extending its scope
to cover refugees worldwide.

3 The Universal Declaration of Human Rights (Article 14), which

states that everyone has the right to seek and enjoy asylum from
persecution in other countries. The 1951 UN Refugee
Convention (and its 1967 Protocol), which protects refugees
from being returned to countries where they risk being
persecuted.
 REGULATIONS
Regulations regarding REFUGEES in INDONESSIA are primarily because Indonesia has not ratified
foreign regulations regarding refugees, especially 1967 Protocol Relating to the Status of Refugees. The
regulations include :

1 Law No. 6 of 2011 on Immigration: This law 2 Presidential Regulation No. 125 of 2016: This regulation lays
provides the legal framework for immigration out the procedures for the handling refugees in Indonesia. It

3 Minister of Law and Human Rights Regulation No. 16

of 2018: This regulation specifies the procedures for the
determination of refugee status and the issuance of
temporary stay permits for refugees in Indonesia.
To address the issue of transnational refugees, Mahfud MD (Former Coordinating
Minister for Political, Legal, and Security Affairs of Indonesia) suggested that
transnational refugees be returned directly to their home country, Myanmar or
