Theft is committed by any person who, with intent to gain but without violence

against or intimidation of persons nor force upon things, shall take personal

property of another without the latter's consent.

Theft is likewise committed by:

1. Any person who, having found lost property, shall fail to deliver the same to the
local authorities or to its owner;

2 . Any person who, after having maliciously damaged the property of another,
shall remove or make use of the fruits or object of the damage caused by him; and

3 . Any person who shall enter an inclosed estate or a field where trespass is
forbidden or which belongs to another and without the consent of its owner, shall
hunt or fish upon the same or shall gather cereals, or other forest or farm
products.

The elements of the crime of theft are as follows:

(1) that there be taking of personal property; (2) that said property belongs to another;
(3) that the taking be done with intent to gain;
(4) that the taking be done without the consent of the owner; and
(5) that the taking be accomplished without the use of violence against or intimidation of persons or force upon things.

MEANING:
According to R.A No. 10883 or known as
New Anti-Carnapping Act of 2016:
Carnapping is defined as the illegal
taking,with intent to gain,of a motor
vehicle belonging to another without the
latter’s consent or by means of violence
againts or intimidation of person, or by
using force upon things.

ELEMENTS OF CARNAPPING

1.Actual taking of the vehicle.


2.The offender has an intent to
gain.
3.The owner consent is lacking.
4.The means employed involves

violence,intimadition,or force
upon things.

PENALTIES
The penalty of carnapping depends
on the manner the crime was
committed, regardless of the value
of the vehicle carnapped , be
punished by imprisonment for not
less than 20 years and 1 day but
not more than 30 years.

 If carnapping is committed without violence against or


intimidation of persons or without force upon things. The
law imposes the penalty of imprisonment for not less than 30
years and 1 day but not more than 40 years.

If carnapping is committed by means of violence


against or intimidation of person or with force
upon things, the penalty of life imprisonment shall
be imposed when the owner, driver or occupant of
the carnapped motor vehicle is killed or raped in the
commission of carnapping.

Any person charged with carnapping or when the


carnapping is committed by criminal groups,
gangs or syndicates or by means of violence or
intimidation of any person or forced upon things;
or when the owner , driver, passenger or occupant of
the carnapped vehicle is killed or raped, the
perpetuator shall be denied bail when the evidence
of guilt is strong.

Concealment of Carnapping:
Any person who conceals carnapping shall be
punished with imprisonment of 6 years up to 12 years
and a fine equal to the amount of the acquisition cost
of the motor vehicle.
Provided, the person violating any provision of
this Act is a juridical person, the penalty herein
provided shall be imposed on its president, secretary
and/or members of the board of directors or any of its
officer who directly participated in the violation.

Any public official or employee who directly the


unlawful acts is guilty of gross negligence of duty or
connives with or permits the commission of any of the
said unlawful acts shall, in addition to the penalty
prescribed,be dismissed from the service, and his/her
benefits forfeited and shall be permanently disqulified
from holding public office.

The Anti-Fencing law of 1979 (PD 1612) defines and punishes “fencing,” or the act of any person who, with intent to gain for himself or for another, shall buy, receive, possess, keep, acquire, conceal, sell, or shall buy and sell, an item which he knows, or
should be known to him,to have been derived from the proceeds of robbery or theft.
