HOLIDAY PAY (Art.

94)
→ No work, with pay
a. Dapat pumasok noong huling araw bago ang holiday.
b. Ang ibang buwanang sahod kasama na ang holiday pay.
→ Double pay pag pumasok: 200%
→ Regular holiday + RD: 30%
→ Overtime (30%)
→ Pag hindi pumasok: 100%

Overtime PAY ( Art. 87)


→ Additional compensation of work performes beyong 8 hours a day.
RATES:
•Ordinary working days: 25%
•Rest day or special day: 30%
•Special day which falls on RD: 30%
•Regular holiday falls on RD: 30%
NIGHT SHIFT DIFFERENTIAL (Art. 86)
→ Additional compensation of 10% of an employee’s regular wage for each hour
work performed.
→ Except
- Government employee’s
- Retail and service establishments employing not more that 5 weeks. (-5)
-Kasambay at Drivers
-Managerial employees
-officicers or members of a managerial staff
-Field personnel
→ Between 10 pm-6 am
SERVICE INCENTIVE LEAVE (Art. 95)
→ rendered at least 1 year of service.
→ 5 days paid leave
EXCEPT:
1. Government employees
2. Drivers
3. Managerial employees
4. Officers/members of managerial staff
5. Field personnel
6. Less than 10 employees. (-10)
SEPARATION PAY (Art. 298-299)
→ termination of employment due to authorized causes.
→ 1/2 month pay per year of service
-reduction of personnel
-closure due to serious losses
-suffering from disease not curable within a period of 6 months
→ 1 month pay per year of service
1. Installation by employer of labor saving devices.
2. Position has been found excessive or unnecessary in the operation.
3. Lack of service assignment of security guard by reason of age.
RETIREMENT PAY (Art. 302)
→ 60 years old - 65 years old

→ Served for at least 5 years.
EXCEPT:
1. Government employees
2. Not more than 10 employees (-10)
→ 1/2 month salary for every year of service
Formula:
Daily rate × 225 days × # of years
13th MONTH PAY (PD 851)
→ worked atleast 1 month during a calendar tear.
→ not less than 1/12 of the total basic salary earned by an employee in a calendar
year.
COMPUTATION:
Total basic salary earned during the year
12 months
→ paid not later than December 24
→ 1/2 of the 13th month pay before opening of the regular school year.
NOT COVERED:
1. The government
2. Kasambahay and Drivers
3. Purely commissions, boundary, or task basis paid a fixed amount.
MATERNITY LEAVE (RA 8282)
→ Female employees, regardless of civil status, employment status, and
legitimacy of her child.
→ 105 days with full pay (Live birth)
→ Additonal 15 days full pay (Solo parent)
→ Additional 30 days without pay (Additional leave)
→ 60 days full pay (miscarriage or emergency termination of pregnancy)
CONDITIONS:
1. Must have at least 3 monthly contributions to SSS in 12 month period.
FREQUENCY:
1. In every instance of pregnancy
→ 7 days transferable to fathers
PREMIUM PAY (Art. 91-93)
→Addional compensation for worked performed within 8 hours on rest days and
special days.
→ No work, No pay

Requirements:

-after the delivery by his wife.

→ first 4 deliveries

LEAVE FOR VICTIMS OF VIOLENCE AGAINST WOMEN AND THEIR


CHILDREN (VAWC) (RA 9262)
→ 10 days full pay
COVERAGE:
- Wife
-Former wife
-againts a woman whom the person has or had sexual or dating relationship.
SPECIAL LEAVE FOR WOMEN (RA 9710)
→ Gynecological disorders
→ 2 months full pay
→ employment service of at least 6 months for the last 12 months.
→ every intance of surgery due to gynecological disorders.

PARENTAL LEAVE FOR SOLO PARENTS (RA 8972)


→ rendered service of at least 6 months
→ 7 working days with pay
-every year
→presented a valid solo paent 10 card.

SERVICE CHARGES (Art. 96)


-amount collected by establishments, such as hotels, restaurants, and other similar
establishments, that is added to the bills for work or services rendered.
→ once every 2 weeks
or
→ twice a month
