Revised Implementing
Rules and Regulations of
PD 1096
Objectives and Intended Learning
Outcomes

This lecture aims to update our co-faculty and students


about the new architectural features of the guidelines
under Rule VII & Rule VII 2005 revised implementing
rules and regulation of PD 1096 and how should be
interpreted and applied to all new developments in the
Philippines.

Outcomes
At the end of this lecture, we shall able to:

1. Re-call and understand the fundamentals and general features


under Rule VII and Rule VIII of 2005 Revised IRR of PD 1096.
2. Compute, interpret and apply the developmental controls, and
requirements in order to satisfy the conditions under Rule VII
and Rule VIII of 2005 revised IRR of PD 1096.
3. Deepen appreciation and recognition on the rationale of 2005
revised IRR under Rule VII and Rule VIII.
Hierarchy of Building Laws & Status
1. Basic Law (PD 1096 or the NBC); unchanged for now but
may still be repealed by an act of Congress (depending on the
progress of DPWH BOC legislative work);

2. IRR of PD 1096/ NBC; revised by the BoC and NBCRC from


2000 through 2003; the 2005 Revised IRR was published April
2005 and took effect 02 May 2005; future revisions still
possible depending on the outcome of the repeal effort on the
basic law;
3. Manual of Procedure; a new DPWH executive issuance for
completion by the BoC and NBCRC;

4. Additional IRR Guidelines and Building and Material


Standards; other executive issuances that may still follow
depending on need assessment by the BoC & NBCRC;

General Features of 2005 Revised IRR of
PD 1096 for the Interest of Professionals
and Students
1. The 2005 Revised IRR applies particularly to all new
structures located in new developments,

• along new road rights-of-way (RROWs),

• new subdivision or estate developments,


particularly reclamation areas;

• rules on bldg. foot-printing and setbacks


(may be somewhat relaxed for new construction
within built-up areas or for renovation/
rehabilitation projects)

Carrying Capacity of Lot – the optimized extent of


physical development that may be introduced into the lot
without causing undue damage, effects or hardship on the
end-users of the proposed development or on neighboring
occupants, entities, properties, lands, developments or the
environment (whether man-made or natural) and with the
proposed building/structure capable of being supported by
existing utility, transportation and service systems or by
proposed expansions/upgrading of such systems within the
immediate future;

Development Control (for Lots and Buildings/


Structures) – a set of inter-acting regulations concerning
the physical utilization of a lot and likewise governing the
planning/design of spaces and/or the use/occupancy of a
building/structure to be introduced (or already existing) on a
lot;
- development controls help determine in detail
the development potential and/or the carrying capacity of all
lots and/or of proposed developments on lots; and

Development Potential of Lot – the maximum extent of


physical development that may be introduced into the lot,
i.e., the erection of the proposed buildings/ structures, after
full compliance with the applicable regulations that need to
be satisfied, specifically those found in the Code, i.e., the
National Building Code of the Philippines

TOTAL LOT AREA (TLA)

- Total “horizontal” surface area of a lot on which a proposed


development (building/structure) is to be erected.

ALLOWABLE MAXIMUM BUILDING FOOTPRINT (AMBF)

-The maximum portion of the lot that maybe occupied by the building at
grade level after satisfying setback, yard and court requirements.
- AMBF is the true buildable area on which a fully enclosed
building/structure can be erected. The area is measured from the
outermost face of the exterior walls of the proposed building or structure.

SETBACKS

- The horizontal distance measured perpendicular from the outermost face


of the building or structure to the property line

PERCENTAGE OF SITE OCCUPANCY (PSO)

- Expressed as the percentage of of the maximum allowable


enclosed floor area of any building in the ground floor in relation to
total lot area (TLA).

Determining the AMBF & PSO

The following shall be observed in the determination of allowable


Maximum Building Footprint (AMBF) fr buildings and related
habitable structures. If the stated rules are compared with:

Note: The more stringent but applicable regulation out of the


aforementioned rules should be observed.
Example 1

A young bachelor has decided that his R-1 zoned property,


with a Total Lot Area (TLA) of 450 sqm located in Antipolo
City shall host his dream house.

The Project Site is an inside lot with 15m wide frontage


facing west. The site is uniformly sloped at 10% towards a
14m wide RROW which has 2m wide sidewalks at both
sides.

What is the allowable maximum building footprint (AMBF)


for the project?

FIREWALL
- A reinforced masonry or reinforced concrete separator with
appropriate fire resistive rating between dwellings, buildings or
structure.
- absolutuely no openings
- shall extend the roof from 400 to 1000mm.

1. Absolute no firewalls are allowed for Residential (R-1),
however;
a. an abutment up to 3.20 meters may be permitted for the
purpose of supporting a carport roof.

c. abutment shall not be longer than 7 meters or 50% of the side
property line in total length, which ever is shorter.
