The Contractor shall pay to the Employer
liquidated damages at 0.15% for each week
or part thereof, of the value of unexecuted
works. The value of unexecuted works shall
be equal to the difference of
1. The approved value of the surveyed &
approved BOQ (inclusive of GST) and
2. The value of executed works (total billed
amount only, inclusive of GST).till the time for
completion or any extension thereof.
The aggregate amount of such liquidated
damages shall in no event exceed 5% of
the value of unexecuted works
