Fundamental Rights stands for those rights which are
inevitable for the mental, moral, intellectual & physical progress & development of people. India borrowed the idea Fundamental Rights from American Constitution which itself absorbed Bill of Rights for their people. Originally, there are seven Fundamental Rights. Later, the Right to property was deleted in 1978 through 44th Amendment of the Constitution. 1- RIGHT TO EQUALITY ( ARTICLE 14- 18) Equality before law & Equal protection of law ( Article 14 ) Prohibition of discrimination only on grounds of religion, race, caste, sex and place of birth ( Article 15 ) Equality of opportunity in public employment ( Article 16 ) Abolition of Untouchability ( Article 17 ) Abolition of Titles ( Article 18 ) 2- RIGHT TO FREEDOM (ARTICLE 19- 22) •Article 19(1) guarantees six rights as follows:- Freedom of speech & expression Freedom of assembly Freedom of association Freedom of movement Freedom of residence and; Freedom of profession
Protection in respect of conviction for offences ( Article 20)
Protection of life & personal liberty (Article 21) Right to elementary education (Article 21 A) Protection against arrest & detention in certain cases (Article 3- RIGHT AGAINST EXPLOITATION (ARTICLE 23-24) Prohibition of traffic in human beings & forced labour ( Article 23 )
Prohibition of employment of children in factories ( Article 24 )
4- RIGHT TO FREEDOM OF RELIGION (ARTICLE 25-28) Freedom of conscience and free profession , practice & propagation of religion ( Article 25) Freedom to manage religious affairs( Article 26) Freedom from payment of taxes for promotion of any religion (Article 27) Freedom from attending religious instruction or worship in certain educational institutions (Article 28) 5-CULTURAL AND EDUCATIONAL RIGHTS ( Article 29-30) Protection of language, script and culture of minorities ( Article 29) Right of minorities to establish and administer educational institutions (Article 30) 6- RIGHT TO CONSTITUTIONAL REMEDIES ( ARTICLE 32) Right to move the Supreme Court for the enforcement of fundamental rights ( Article 32 )through the writs including:- (I)Habeas Corpus (II)Mandamus (III)Prohibition (IV)Certiorari (V)Quo –warranto CORE SIGNIFICANCES OF FUNDAMENTAL RIGHTS Essential & Inseparable Pro-citizenry Justiciable Non-negotiable
