What is Torrens system?
Torrens title is a system of
land registration,
Introduced by the British
This law is implemented via the
National Land Code 1965 and is
enforced throughout the country except
for Sabah and Sarawak
The land title will be formally
provided in duplicate, one (RDT)
will remain with the Land Office
or Land Registry Office, while the
another one (IDT) will be kept by
the land owner.
RDT
RDT is the Registered document of
title, which is stored and will be
kept by the land office.

IDT
IDT stands for issued document of
title, which means the title issued
to the owner
Both IDT and RDT contain the
same information, but RDT is
more conclusive than IDT.

Therefore, we need to refer to the


RDT by making the private or
official search at the land office to
get the latest information on that
particular land, such as caveat,
charge and etc…
Land dealings such as transfer,
lease, mortgage, lien and easement
will be registered in the title .

The Land Office or Land Registry


Office has the duplicate of titles
with them so it will ease the work
of people involved.
CATEGORIES OF LAND USE
NLC 1965 recognized three (3)
categories of land use:

1. Agriculture

2. Building

3. Industry
EXPRESS CONDITIONS &
RESTRICTIONS IN INTEREST
S120 empowers the State Authority to impose
express conditions & restrictions in interest when
alienating land.

They must be endorsed on or referred to in the


document of title.

They may be required continuous performance


or subject to fixed term.

They bind the proprietor.


(a) Agriculture – the express
condition could be for planting of
oil palm, rubber trees, durian
trees etc….. Only
 “Tanah yang terkandung dalam
hakmilik ini hendak ditanam
dengan kelapa.”
(b) Building – the express condition
could be for residential or
commercial building only.
“Tanah yang terkandung didalam
hakmilik ini hendaklah diguna
semata-mata untuk sebuah rumah
teres biasa (single storey) jenis
kekal dibina mengikut pelan yang
diluluskan oleh Majlis
Perbandaran Subang Jaya”
(c) Industry – the express condition
could be for a flatted factory,
industry parks etc…

“Tanah yang terkandung didalam


hakmilik ini hendaklah
digunakan semata-mata untuk
Perusahaan Ringan”

1. Malay reservation restrictions

2. Bumiputra restrictions

3. Transfer of ownership
restrictions
