GENERAL CONDITIONS OF CONTRACT IN
NOTICE INVITING TENDER (NIT) OF
CPWD WORKS
Eligibility criteria for association of agency for execution
of specialized work
 Applicable for all the Bidders, the contractor should have an arrangement for
associating with another agency who has the required experience of executing
specialized work technology related work. If the main contractor does not have the
required experience of working with specialized work technology. The details of the
associated agency and the related document qualifying criteria of specialized work
technology work shall be submitted by the Bidders (Main contractors) within 05
days of award of work and get this approved by Engineer- in-charge..
ADDITIONAL MANDATORY DOCUMENTS

 Valid Notarized Affidavit of Non-black listing by CPWD/State/Central


Departments/PSU/Autonomous bodies as per Form “J” on Non-Judicial stamp paper of
Rs.100/- duly signed by the authorized person of agency / firm.

 Valid Notarized Affidavit of ‘No back to back execution of work as


per Form “G” on Non-Judicial stamp paper of Rs.100/- duly signed by
the authorized person of agency/ firm.

 Declaration about site inspection


CLAUSES OF CONTRACT
 Clause 1
 Time allowed for submission of Performance Guarantee, Programme Chart (Time and

Progress) and applicable labour licenses, registration with EPFO, ESIC and BOCW Welfare

Board or proof of applying thereof from the date of issue of letter of acceptance is 7 days

(The Performance Guarantee shall be submitted by the Contractor on format as per GCC

2023 and shall be initially valid up to the stipulated date of completion plus minimum 6

Months beyond that)

 Clause 7A
 Payment of bills after submission of statutory documents No RAR Bill shall be paid for the

Work till the applicable labour licenses, registration with EPFO, ESIC and BOCW(Building

& other Construction Workers)Welfare Board, whatever applicable is submitted by the

Contractor to the Engineer-in-Charge.


 Clause 9 : PAYMENT OF FINAL BILL

 If the final bill is submitted by the contractor within the period

specified and payment of final bills is made by the deptt. after

prescribed time limit , a simple interest @ 5 % per annum shall be

paid to the contractor from the date of expiry of prescribed time

limit, provided the final bill submitted by the contractor is found

to be in order applicable is submitted by the Contractor to the

Engineer-in-Charge.
PAYMENT DUE TO INCREASE l DECREASE IN PRICES

 Clause 10C: Payment on Account of Increase in Prices/ Wages due to

Statutory Order(s)

 Clause 10(CC) is applicable in contracts where the stipulated period for

completion is more than 12 months.

(a) Where provisions of clause 10CC are applicable, provisions of clause 10C will not

be applicable.

(b) Where provisions of clause 10CC are not applicable, provisions of clause 10C

will become applicable.


 Clause 19A: Labour Laws to be complied by
the Contractor

 No labour below the age of eighteen years shall be employed on the work.
PARTICULAR SPECIFICATIONS &
SPECIAL CONDITIONS
1. GENERAL

a). Unless otherwise provided in the schedule of quantities, the rate tendered by the
contractor shall be all inclusive and shall apply to all heights, lifts, leads and depth of the
building and nothing shall be payable to him on this account.

b). No claim for idle establishment and labour, machinery and equipment's, tools and
plants and the like, for any reason whatsoever, shall be admissible during the execution
of the work as well as after its completion.

c). The contractor shall comply all the preventive and protective environmental steps as
stated in the MoEF guidelines, 2010.
2. CONDITION FOR CEMENT: -
 The Contractor shall procure 43 grade Ordinary Portland cement (conforming to IS : 8112) or

Portland slag cement (conforming to IS : 455) or Portland Pozzolana Cement (PPC) (Fly ash

based) – conforming to IS : 1489 (Part-I) as required in the work, from reputed manufactures of

cement. Supply of cement shall be taken in 50 Kg bags bearing manufacturer’s name and ISI

marking.

 In case test results indicate that the cement arranged by the Contractor does not conform to the

relevant BIS codes, the same shall stand rejected and shall be removed from the site by the

Contractor at his own cost within a week’s time of written order from the Engineer- in-charge to

do so.

 The cement shall be got tested by Engineer –in –Charge and shall be used on the work only after

satisfactory test results have been received. All expenditure to be incurred for testing of samples e.g.

packaging, sealing, transportation, loading, unloading etc., including testing charges shall be born by the

contractor.
3. CONDITIONS FOR REINFORCEMENT STEEL:-

 The contractor shall supply free of charge the steel required for testing

including its transportation to testing laboratories. The cost of tests shall be

borne by the contractor.

 final payment shall be made on the basis of weighted average of all the

consignment. The decision of the Engineer-in-charge as regards the random

samples and average weight shall be final and binding on the contractor

and no claim of any kind shall be entertained in this regard.


4. REINFORCED CEMENT CONCRETE WORK

1. DESIGN MIX CONCRETE

 The concrete mix design will be carried out by the contractor through one of the following laboratories / Te

houses and ready mix concrete shall conform to accepted design mix. a) IIT Chennai. b) Pondicherry Engineerin

College, Puducherry or any other Government institution as approved by Engineer-in-charge.

 The contractor shall submit the mix design report from any of above approved laboratories for approval

Engineer-in-Charge within 45 days from the date of issue of letter of acceptance of the tender.

 The testing charges for Mix design in all cases shall be borne by the contractor.

 The contractor shall be fully responsible for quality of concrete including input control, transportation an

placement etc.
4. REINFORCED CEMENT CONCRETE WORK -

 Concrete shall be handled from the place of mixing to the place of final

deposit / placement by methods, which prevent segregation, or loss of

any ingredients and contamination.

 Concrete shall not be dropped into place from a height more than 1.5m.
5. TOLERANCE IN FINISHED CONCRETE
The formwork shall be so made as to produce a finished concrete
true to shape, lines, level, plumb and dimensions as shown in the
drawings subject to the following tolerance unless otherwise specified
In this specification or drawings.
1. Wall/Column/Fins:
i Variation from the plumb ± 6mm Upto 3m height
ii
Variation from the plumb of ± 6mm Upto 6m height
conspicuous liner
iii Variation in the size of wall openings (+)15mm
(-) 6mm
iv
Variation in parapet wall thickness ± 6mm
Upto 30cm thickness

Slab, Beam & Girder Forms:


Variation from the level or from the specified grid for beam soffit before removal of shore
(a)In any 3m ± 6mm
6. SAFETY MEASURES AT CONSTRUCTION SITE
In order to ensure safe construction, following shall be adhered for strict compliance at
the site:-

 The work site shall be properly barricaded.


 Adequate signages indicating ‘Work in Progress – Inconvenience caused is Regretted’
Diversion Signs shall be put on the sites conspicuously visible to the public even duri
night hours. These are extremely essential where works are carried out at public plac
in use by the public.

 The construction malba at site shall be regularly removed on daily basis.


 All field officials and the workers must be provided with safety helmets, safety sho
and safety belts.

 Proper MS pipe scaffoldings with work – platforms and easy-access ladders shall
provided at site to avoid accidents.

 Necessary First-Aid kit shall be available at the site.


7. LIST OF EQUIPMENT FOR SITE LABORATORY TO BE
MADE AVAILABLE BY THE CONTRACTOR AT HIS OWN
COST (Refer Clause 10 A of Schedule ‘F’)
1. LABORATORY TESTING INSTRUMENTS

 Balances
 Ovens
 Sieves
 Sieve shaker
 Equipment for slump test
 Dial gauges
 100 tones compression testing machine
 Graduated measuring cylinders 200 ml capacity
8. CONSTRUCTION PHASE AND WORKER FACILITIES
 The contractor shall provide potable water and other amenities for all workers as
per the contract.

 The contractor shall provide the minimum level of sanitation and safety facilities
for the workers at site

 Provide protective equipment; helmets etc.


 Provide measures to prevent fires. Fire extinguishers and buckets of sand to be
provided in the fire-prone area and elsewhere.

 Provide sufficient and suitable light for working during night time.
9. LIST OF APPROVED MATERIALS
(PREFERRED MAKE OF MATERIALS (FOR CIVIL WORKS)

Unless otherwise specified, the brand / make of the material as specified in the item
nomenclature, in the particular specifications and in the list of preferred make
attached in the tender, shall be used in the work. In case of non-availability of the
brand specified in the contract the contractor shall be allowed to use alternate
equivalent brand of the material subject to submission of documentary evidence of
non- availability of the specified brand and prior approval of Engineer-in-Charge.
Sample/Make of all the materials will be used only after approval of the
Engineer- in-Charge
10.Safety Codes & Statutory Regulations:

 The contractor shall provide necessary barriers, signals and other safe
measures while executing the works wherever necessary so as to avo
accident. Contractor shall be liable, in accordance with the Indian law an
Regulations for any accident occurring due to any cause. The department sha
not be responsible for any accident occurred or damage incurred or claim
arising there from during the execution of work. The contractor shall cover th
risk. No extra payment would be made to the contractor due this.
